TEPJF Chamber President Saved From Committing Premature Campaign Acts

Luis Espíndola Morales , Magistrate, President of the Specialized Regional Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), was saved from committing acts of premature campaigning .

The president of the TEPJF Chamber, who is also a candidate for the Superior Chamber magistrate , published a photograph with the ballot, the names of the candidates, including his own, and the number 8, which corresponds to him on the ballot, which could constitute a call to vote at a prohibited time.

However, prior to the session of the Complaints and Reports Commission of the National Electoral Institute (INE), the magistrate deleted the publication on the social network X.

During the session, the councillors pointed out that these were completed acts and that since the publication had been deleted, they could not issue precautionary measures, which would order its removal, since that had already happened.

“I am always respectful of the law and the democratic process. To allow the procedure to follow its legal course, I decided to take down the questioned publication. Freedom of expression cannot be censored or used for political or factional purposes,” he said.

He said he trusts “the institutions and that everything will be resolved in accordance with the law. I will continue working with respect, honesty and closeness for our community. My commitment is to the citizens and to the law.”

For its part, the Complaints and Reports Commission stated on the social network X, the candidate published a model of an electoral ballot for the election of the magistrates of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), as well as a phrase in which he refers to the number 8, the same one with which said person is identified within the respective ballot.

By unanimous vote, the court determined that the adoption of precautionary measures was inadmissible, since the publication under study has been deleted, and therefore these are faits accomplis.

The members of the Complaints and Reports Commission reminded the contenders for the current Extraordinary Electoral Process of the 2024-2025 judging persons that there is no pre-campaign stage and possible acts of proselytism must be avoided before the corresponding stage, for which reason they invited them to adjust their actions to the electoral regulations and to respect the time established to carry out the campaign.
