He threw a baby on the floor and got eight years in prison. The court overturned the verdict
Last year, a resident of Bartoszyce was sentenced to eight years in prison for abusing an eight-month-old child in the absence of his partner. According to investigators, Patryk N. threw the boy to the floor. The child had a brain hematoma, broken legs and arms.
After all, the 23-year-old hid on the other side of Poland. In Krakow, he rented an apartment and found himself a temporary job. After returning from work, he was stopped by Olsztyn police. He was surprised by their appearance in front of the apartment.
Initially, Patryk N. was charged with assault, but the prosecutor decided to change the classification. Ultimately, he was charged with abusing a boy and attempted murder.
– He explained to us that the baby fell from the cot while he was feeding it. However, experts determined that the injuries were caused by violence: tugging and pulling the child's limbs – Daniel Brodowski, spokesman for the District Prosecutor's Office in Olsztyn, told us at the time.
In addition to broken legs and arms, the baby also had a brain hematoma. If the injuries were to occur during a fall, then – according to experts – the infant would have had to fall from a height of at least three meters.
New judges in the panelIn December 2023, the District Court in Olsztyn sentenced the man to eight years in prison and the obligation to pay PLN 80,000 in partial compensation. The court also found him guilty of physical abuse of the child, beating and pulling him.
However, it turns out that the Court of Appeal in Białystok, which issued a final judgment in this case, included two so-called neo-judges. Therefore, when Patryk N.'s defense attorney invoked this, the Supreme Court overturned the judgment and referred the case for reconsideration. However, the man was not released, but a decision was issued on temporary arrest.
This concerns the nomination of two judges who were appointed in a procedure involving the so-called neo-KRS, i.e. the National Council of the Judiciary after changes in the regulations (the amendment came into force in 2018), after which the 15-person judicial composition of the council is selected by the Sejm, and not - as before - by judicial circles. After these changes, the KRS is considered by the current authorities and some lawyers to be an unconstitutional and politicized institution.
