Record benefit from the Medical Event Compensation Fund - over PLN 220,000

A patient who was admitted to hospital for routine surgery underwent six operations and ultimately a thigh amputation as a result of medical errors. The Patient Rights Ombudsman awarded him the maximum benefit from the Medical Events Compensation Fund.

A seemingly routine knee surgery ended in serious harm to the patient's health. During the procedure, the surgical site became infected. On the fourth day after the surgery, symptoms of inflammation and impaired healing appeared, but despite warning signs, the patient was discharged home. His condition quickly deteriorated and he was readmitted to the hospital two days later in a much more serious condition.

Experts analyzing the case pointed to numerous failings on the part of the medical staff. Key problems include:

• lack of microbiological diagnosis before starting empirical antibiotic therapy,
• failure to adhere to aseptic techniques and improper monitoring of the postoperative wound,
• secondary infection as a result of long-term hospitalization and body burden with antibiotics and comorbidities.

As a result of this negligence, six surgical interventions were necessary, including a thigh amputation. As a result, the patient became disabled.

Taking into account the extent of the damage and the complexity of the situation, the Patient Rights Ombudsman Bartłomiej Chmielowiec decided to pay the maximum possible amount from the Medical Event Compensation Fund, i.e. PLN 222,800. The decision was based on medical documentation and opinions of independent specialists.

The Compensation Fund enables patients to obtain compensation quickly without the need for years of legal proceedings. This solution is also beneficial for doctors, because they are not drawn into expensive and lengthy proceedings.
