DA's report cited 'inconsistencies' in probe of fatal crash involving Kyren Lacy

The district attorney's office that investigated a December 2024 fatal crash that led to the arrest of Kyren Lacy found that the Louisiana State Police probe into the incident had "several inconsistencies" and disputed the police's characterization of the NFL hopeful's actions.

An April 11, 2025, review by an investigator in the office of Lafourche Parish District Attorney Kristine Russell, stated: "The report provided to this office by Louisiana State Police has several inconsistencies which were used to base their opinion and conclusion of the crash."

ABC News obtained the district attorney's report on Thursday.

"We cannot comment on the District Attorney's investigation, as we were not part of that process," a spokesperson for the Louisiana State Police told ABC News on Thursday. "Louisiana State Police stands by the findings of its crash investigation, which relied on Troopers' specialized training, eyewitness accounts, video evidence, and physical evidence to determine contributing factors. Those findings were forwarded to the Lafourche Parish District Attorney's Office."

Lacy, who was a star player for Louisiana State University before declaring for the NFL draft in 2024, was arrested in January and charged with negligent homicide in connection with the Dec. 17, 2024, crash that led to the death of 78-year-old Herman Hall.

Days before a grand jury was set to hear the case, Lacy died by suicide, according to officials. He was 24.

Earlier this week, officials with the Louisiana State Police released surveillance footage from the incident from a nearby "Go Bears" gas station and repeated their conclusions about what they believe led to the crash.

State police said Lacy, who was heading south on Louisiana Highway 20 in a lime-green Dodge Charger, was speeding when he passed four vehicles in a no-passing zone before the crash.

Police said the driver of a gold truck traveling northbound abruptly braked and swerved to avoid a head-on collision with Lacy's Charger. According to police, the driver of a Kia Cadenza traveling behind the truck also saw the approaching Charger and "in reaction" swerved left into the southbound lanes and collided with a Kia Sorento, in which Hall, the man who died, was a passenger.

State police said that while Lacy's Charger did not impact any of the vehicles, "all evidence collected supports the conclusion that Lacy's reckless operation of the green Charger in oncoming traffic triggered the chain of events involving the other drivers, ultimately resulting in the fatal crash."

The DA's report, however, concluded that while Lacy was driving at a high rate of speed when he passed four vehicles, including an 18-wheeler, in a no-passing zone, he was back in his "correct lane" well before the crash occurred.

Had it been a stretch of roadway where cars were permitted to pass each other, the prosecutor's report said the point at which Lacy returned to his lane would have been three times the required distance and he "would not have been responsible for any crash."

The prosecutor's report also stated the evidence shows the driver of the Kia Cadenza was following too closely behind the gold truck and swerved into the southbound lanes to avoid hitting the truck -- not to avoid Lacy's Charger.

ABC News reached out to the DA's office for further comment but has not heard back.

In a Jan 10, 2025 statement around the time of Lacy's arrest, police also accused Lacy of fleeing the scene and failing to render aid. When he was arrested on charges of negligent homicide and reckless operation of a vehicle, police also sought charges of felony hit and run against him.

But according to the DA's report, "the evidence submitted in the crash report does not support that Kyren Lacy should have known that his actions were the cause of the crash."

The DA's findings appear to bolster claims made by Lacy's attorney, Mathew Ory, in an interview with Houma station HTV 10 last week.

"[Kyren Lacy] had no idea he caused this accident because he didn't think he caused the accident. He didn't cause the accident," Ory said.

ABC News reached out to Ory but requests for comment were not returned.
